  1. The Campaign shall commence from 17/01/2017 and close on 31/03/2017 (‘the promo period’).
  2. Customers, who avail the online services of UAE Exchange & Financial Services Ltd. (‘the Company’), viz. Foreign Exchange, Travel & tour services, Loans, gifting services through XPay etc. through www.uaeexchangeindia.com or www.uaeexchangetravel.com or forex.uaeexchangeindia.com or loan.uaeexchangeindia.com during the promo period, will be eligible to participate in this Campaign.
  3. For each successful transaction done with the Company, the Customer will get a SMS to such mobile number as provided by the Customer. Such mobile number will be the coupon number for the Campaign. Company shall not entertain any claim with regard to non-receipt of SMS in case the mobile number provided by the customer is wrong and there will be no second re-issuance of SMS for that transaction.
  4. A customer who has registered under DND (Do Not Disturb) facility and who willingly offers to participate in the Campaign by registering their mobile number shall not raise any future disputes regarding receipt of promotional SMS.
  5. The draw will be computer generated and will be held on the 1st week of April, 2017. To avail the prize, winner will have to produce id proof & SMS received from the Company.
  6. Winners list will be announced / published in the home page of the UAE Exchange web site (www.uaeexchangeindia.com) and in our Facebook fan page UAE Exchange India on the same/next day. Winners may also be contacted over phone/email id (given by them at the time of participation). Though all reasonable efforts will be taken by the Company to contact the winners & inform them about the prize, the Company shall not entertain any claim with regard to non-receipt of timely information.
  7. First prize is Google Nexus phone, 2nd prize is Nikon camera, 3rd prize is Philips Home Theatre system. Prizes are neither transferable nor can substituted with any cash equivalent or otherwise. Giveaway prize images displayed on the flyers, banners and on website are for illustration purpose only and may differ in actual size and model. The prizes should be availed on or before the 15 days from the date of announcement of the Prize, failure of which the prize will stand canceled & lapsed. Only one transaction per registered mobile number will be counted for the Campaign.
  8. The Company makes no representations or warranties as to the quality, suitability or merchantability of the prize offered in this Campaign. The Prize is subject to its manufacturer’s standard limited warranty regarding same and the Company makes no express or implied warranty with respect to the Prize.
  9. The Company reserves the right to publish the winners’ photos in any media/forum for present/future promotional, marketing and publicity purposes.
  10. The Company reserves the right to amend the scheme at any time during the promo period, without any prior notice. In case the offer is made void in future under any law, or regulatory authority, the Company shall not be liable to provide any prize and/or compensation to the winners.
  11. All disputes arising or in connection of this Campaign are subjected to laws of India and the exclusive jurisdiction of courts at Kochi. The decision of the Company on all matters relating to the Campaign (including but not limited to any dispute/controversy arising out of this Campaign) shall be final and binding.
  12. UAE Exchange staff members/ employees of associate companies and their relatives are not eligible to participate in this Campaign.
  13. By participating in the Campaign, it shall be deemed that the customer has read, understood & accepted the terms and conditions as specified herein.
  14. In any case, this promo shall not be construed as an inducement from UAE Exchange to its customers to avail the services. Availing of services and participation in the promo shall be purely based on the choice of customers.

Objective of the policy

The Customer Care Redressal Policy was formed with an aim to provide a quick redress to customer issues. In case of complaint, we have a smooth review mechanism to identify our shortcomings and overcome them quickly.

Principles of the Policy

We have drafted the Customer Care Redressal Policy keeping our customer’s needs in mind. The prescribed document is available at all branches and employees are aware about the same. It is based on the following principles

  • Fair treatment to customers
  • Customer complaints to be dealt with completely, courteously and on priority basis.
  • Complete information provided to the customers to escalate their complaints, to a higher hierachal authority
  • Employees work in good faith and in the interest of the customers.

Customer Awareness: – The Company shall display at conspicuous place in all branches, the name and contact details (Telephone/Mobile number and E mail id) of a Grievance Redressal Officer who can also be approached by the Customer for the resolution of any complaints against the Company. Handling Customers Complaint

However, if you feel that our services need improvement and wish to lodge your suggestions/feedback,we welcome your valuable suggestions and feedbacks.

In case of any complaint / grievance about our service or products, you are requested to obtain the feedback form from the branch & submit the same to the Branch Head in writing. Your queries / suggestions / feedbacks / complaints / grievances may also be brought to our notice via letter/email to the branch address/email id, which shall be displayed at the branch. In case, if the Branch Head is unable to redresss your grievance, then he shall escalate the same to his Regional Head, who in turn shall hear your grievance & take appropriate steps to redress your greivance.

If you are not satisfied with the redressal machanism provided from the concerned branch, you are free to contactour Customer Care through email / telecall / livechat / website & submit your grievances/complaints. The Customer Care Executive will escalate your query to the concerned Regional Head’s. In case of non-redressal from the above forums, you may also directly write to the Managing Director, UAE Exchange.

However, we assure you that, your grivances/complaints will be redressed within 24 hours at the initial forum itself, without burdening you to approach higher forums.

Before registering with XPAY/UAE Exchange India Application, you are required to read and accept the below Terms & Conditions. By continuing with registration for XPAY, it shall be deemed that, YOU HAVE EXPRESSLY AGREED TO BE BOUND BY THE FOLLOWING TERMS & CONDITIONS. These Terms & Conditions form an agreement between you and UAE Exchange & Financial Services Ltd. (UAE Exchange), that governs your access to XPAY login and use of XPAY service to facilitate the purchase of goods/services or utility/essential service from merchants that has tied up with UAE Exchange. You are free to call our toll free no. or visit the nearest branch in case of any doubt or for clarification(if any).

1. Terms

The following defined terms appear in these Terms & Conditions.

a) Issuer/We/Company

Issuer/we/Company mentioned hereunder refers to UAE Exchange that operates payment systems by issuing prepaid payment instruments to individual/organizations, as per the authorization received from the Reserve Bank of India.

b) Holder/Customer/ You/Buyer

Individual/organization who has registered with the Company for availing the XPAY service for purchase of goods & services and utility/essential bill settlements, including Domestic Money Transfer Services(DMTS).

c) Agent

A person/retail establishment/ institution, who ties up/ registers via a separate registration process for providing XPAY service and is governed by the terms therein.

d) XPAY

XPAY is Pre-paid Payment Instrument of the Company that facilitates purchase of goods and services & other utility bills /essential services, including DMTS, against the value stored in XPAY. The value stored on such instruments represents the value paid for by the customer by cash or bank mode after prescribed deductions.

e) Product

Products offered by the Company to customers via Application/Site including XPAY.

f) Pre-paid Payment Instrument

XPAY is a virtual card that can be accessed by allotted login ID/User ID & transaction can be done by using secret “MPIN” password that is issued to the customer by Issuer.

g) Payment Transaction

The processing of a payment Service through mobile/internet that result in the debiting or charging of the XPAY balance of the customer and the crediting of Merchant’s account/ beneficiary bank account and/or payments made to the Company for Services (Ticketing/ Forex Booking services) availed by the customer.

h) Login/User ID & MPIN

Login/User ID and Registered Mobile Number is used to access the XPAY & MPIN which is secret digit password. Both are simultaneously issued to the customer by the Issuer immediately after XPAY registration for authenticating transaction at the time of making a payment to the Merchant.

i) OPT

OTP is One Time Password generated for validating the customer registered mobile number and for proceeding with the transactions

j) Merchant Code

A digit numerical code issued to the Merchant/Agent by the Issuer after the formal tie up for facilitating XPAY service to customers, that is prominently displayed at the Merchant counter to be used while making payment.

k) QR Code

QR Code is a metrix barcode issued by the Company to customer/merchant to identify the customer and merchant details and the amount of transaction initiated by them.

l) XPAY Mobile Application/UAE Exchange India Application/Mobile Application/Application

A mobile application through which customer/Merchant can carry out the transactions. Mobile Application requires a smart phone with GPRS connectivity for its operations.

m) XPAY Site

XPAY Site refers to www.xpayindia.com or XPAY option linked through www.uaeexchangeindia.com

n) Registered Mobile Number

Registered Mobile Number is the mobile number used by Customer for Signing up/Logging in which shall form a part of user/Customer identity along with user/Customer name.

o) Merchant payment

It refers to the payment being made to various Service Providers who have tied up with the Company to receive payment via XPAY.
  1. p) Merchant/Service Provider
A person/retail establishment/ institution, who ties up/registers via a separate registration process for receiving payments via XPAY service and is governed by the terms therein.

2. Registration Requirements & Process

2.a. For Customers

Basic Requirement – By accepting these terms & conditions or by otherwise using the Services of the Site, you represent that you ar at least 18 years of age and have not been previously suspended or removed from the Services. You represent and warrent that you have the right, authority and capacity to enter into this Agreement and to abide by all the terms & conditions of this Agreement. You shall not impersonate any person, entity or falsely state or otherwise misrepresent identity, age or affiliation with any person or entity.

Requirements for Registration – Registration is mandatory for availing XPAY Services. Filled in XPAY Application Form shall be submitted at the nearest branch of the Company for XPAY Registration. However, for doing transactions above Rs.10,000/-, Customer must compulsorily submit necessary KYC documents [valid Photo ID Proof & valid Address Proof (mentioned below)] with the Company. Facilities will be shortly provided by the Company to the Customers for Registering via Site/Mobile Application.

Sign up/Logging in –Customers shall enter the mobile number and other information (if any) required for validating the registered mobile number. Customer Mobile number will be validated by generating an OTP and will be sent to the Registered Mobile number of the Customer. By submitting the thus received OTP, you shall be directed to the page where you can opt for the service you need. Simultaneously with the registration, a Customer MMID will be generated, which will be visible to you in your application. By clicking the same, you will get the MMID in your registered mobile number as SMS. For transactions requiring MMID, you shall enter this MMID and proceed for initiating transactions through XPAY.

2.b. For Merchant registration

All interested shops and service establishments can tie-up with Issuer for XPAY. Merchant will have to register by submitting the required details including its Bank details and requisite ID copy. Facilities will be shortly provided by the Company to the Customers for Registering via Site/Mobile Application. After checking the documents, a login User ID & Merchant Code will be given to Merchant for logging in to the application & for effecting transactions. The Merchant list will be displayed in Merchant List Screen provided in Company’s website.

Note – Issuer is very strict on the Customer/Merchant identity proof (as given under Cl.2.a & 2.b) and reserves all right to reject any registration request or reloading request to comply with Anti- Money laundering measures/ Combating Financing of Terrorism guidelines issued by the Reserve Bank of India with regard to Prepaid instruments.

2.c.   For Agent registration

All interested shops and service establishments can tie-up with Issuer for providing XPAY services to customers through their outlets. Agents will have to register by submitting the required details including its Bank details and requisite ID copy along with executing an agreement with the Issuer. After verification of which, an Agent login User ID & Agent Code will be given to Agent for logging in to the application & for doing transactions. The Issuer will maintain an Agent Balance for each Agent which needs to be sufficiently funded for doing transactions.

2. d. Loading/Re-loading

Customers/Merchants can load/re-load thier XPAY Account/Agent Balance via Internet Banking or Credit/Debit Card payment or by remitting in cash mode at any of the Company’s branch across India. Balance in the XPAY Account at any point of time can not exceed Rs.50,000/-.

3. Payment Transaction Processing

3.a. For Customers

This application facilitates the customers to send money to beneficiery Bank Account (Domestic Money Transfer Service with strict compliance to DMTS rules), send money to another XPAY Account, payment towards services availed from the Company other than DMTS (Ticketing & Forex Booking) and for Merchant payments. Merchant payment includes payment towards purchase of goods & services and settlement of utility bills/ essential services viz. electricity bills, water bills, telephone/mobile phone bills, insurance premium, cooking gas payments, rental for internet/Broadband connections, Cable/DTH subscription and Citizen services by Government or Government bodies. Merchant payment is possible only where such Merchant is XPAY enabled. All transactions can be processed through this application with GPRS connection. Customers/Merchants are also able to transact through Company’s website using the User ID & MPIN provided. Customer may also make payment to Merchants using other payment modes available in XPAY Site/Application, wherein the transfer of fund will be at the risk of Customer/Merchant.

By signing into this application, Customer authorizes the Issuer to charge or debit to customer’s XPAY account to complete processing of a Payment Transaction.

 

Note – Customer acknowledge and agree that the Merchant payments are towards the purchases of Products/services or utility payments between the Customer and the Merchant and not with the Company/XPAY. Company/XPAY is not a party to the purchase of Products/Services and Company/XPAY is not a buyer or a Merchant in connection with any Payment Transaction, unless expressly designated as such in the listing of the Product.

 

3.b. For Merchants

Merchants may view their last five transactions in the Balance Report in this application. Daily business collection will be credited to merchant’s bank account on the next day if the amount due is Rs.1000/- or above, or else as per merchant request. For security reasons no SMS will be send for any transaction or for loading confirmation.

Note – XPAY may delay payment processing of suspicious transactions/ transactions which may involve fraud, misconduct, or violate applicable law, or other applicable XPAY policies, as determined in XPAY’s sole and absolute discretion.

 
  1. No Endorsement of Products
UAE Exchange don’t endorse the quality/ merchantability of the goods/service, you opt to thus purchase/avail using XPAY. 

5. Permissible Payment Transactions

You may use XPAY Application/Site solely for processing Payment Transaction towards purchase of goods /services and utility bills/essential services that is purchased from a Merchant through a legitimate, bonafide sale of the Product or Domestic Money Transfer Service. XPAY services can not be used for cross boarder transactions. XPAY must not be used to receive cash advances from Merchants or to facilitate the purchase of cash equivalents (travelers cheques, prepaid cards, money orders, etc.). XPAY services shall not be used to process Payment Transactions in connection with the sale or exchange of any illegal goods or services or any other underlying illegal transaction. In particular, you shall not use XPAY or process Payment Transactions in connection with the sale/purchase of goods or services, or other remittances that are prohibited & against the law of the land. Company reserves the right to suspend or terminate your use of XPAY, in the event of non compliance of the above.
  1. Buyer Responsibility for Taxes
Payment of any applicable taxes (if any) arising from the use of XPAY is customer’s responsibility. Customer hereby agrees to comply with all the applicable tax laws, including the reporting and payment of any taxes arising in connection with Payment Transactions.
  1. Validity, Refunds & Redemptions
XPAY Registration shall be valid for a period of one year from date of successful registration and can be renewed thereafter by giving instruction for renewal through this application or directly by visiting the nearest branch. All Payment Transactions processed through the XPAY are non-refundable to the customer and are non-reversible by Customer through the XPAY. The loaded amount is interest free & redeemable only if the scheme is wound up as per RBI guidelines. Note : Any refunds by Service Providers shall be as per refund policy of the concerned Service Provider . Company/ XPAY shall not be liable for any such refunds. However, if any Merchant payment is done through XPAY wallet balance, the refund from the Service Provider shall come to Customer’s XPAY wallet directly. In case of payment by any other modes, the refund shall come to originating account of the Customer and Company shall have no role/responsibility for any refunds.
  1. Limitations on the Use of Service
Issuer may establish general practices and limits concerning the use of XPAY, including without limiting individual or aggregate transaction limits on the rupee amount or number of Payment Transactions during any specified time period(s), in accordance with the guidelines of the Reserve Bank of India. We do not warrant that the functions contained in XPAY will be uninterrupted or error free and we shall not be responsible for any service interruptions (including, but not limited to, power outages, system failures, mobile errors or other interruptions that may affect the receipt, processing, acceptance, completion or settlement of Payment Transactions).
  1. Issuer Not A Banking Institution
Issuer processes Payment Transactions on behalf of Merchants. Issuer is not a bank. Funds held by the Issuer in connection with the processing of XPAY Payment Transactions are not deposit obligations of the customer and are not insured for the benefit of customers by any governmental agency. Such funds are interest free and are maintained only for making payments to the participating merchants. No loan is permissible against such deposits.
  1. Termination of Service
Issuer may, in our sole and absolute discretion without liability to you or any third party, terminate your use of XPAY for any reason, including serious breach/violation of any Terms & Conditions. Upon termination, we have the right to prohibit your access to XPAY until the breach/ violation is sorted out to the satisfaction of Issuer and regulatory authorities.
  1. Unclaimed Property
If issuer is holding funds due to customer/merchant arising from a Payment Transaction processed through XPAY or otherwise, and the Company is unable to contact concerned customer/merchant and have no record of their use of XPAY for several years, applicable law may require the Company to report these funds as unclaimed property. In such events, the Company will try its best to locate such customer/merchant at the address provided at the time of registration/last updated address. But if unable to locate, Company may be required to deliver any such funds to the applicable state as unclaimed property. Company reserves the right to deduct a dormancy fee or other administrative charges from such unclaimed funds, as permitted by applicable law.
  1. Privacy
Customer understands and agrees that personal information provided to the Company via this application is subject to the XPAY Privacy Policy.
  1. Intellectual Property
This application & XPAY are the sole and exclusive property of the Company. Company retains all right, title and interest (including all copyright, trademark, patent, trade secrets, and all other intellectual property rights) of the Site & XPAY. The Site & XPAY is protected by copyright, trademark, patent, trade secrets, unfair competition, and other laws of worldwide, through the application of local laws or international treaties. Any unauthorized use, reproduction or modification of this Site may violate such laws. Customer/Merchant shall immediately bring to the notice of the Issuer, all matters regarding infringement and/or misuse of the same, within their knowledge & information.
  1. Use of Electronic Communications
Issuer may communicate with customer regarding XPAY or other Services of the Issuer by means of electronic communications, including (a) sending electronic mail/text message to the email address/Mobile Number provided by customer at the time of registration, or (b) posting notices or communications on XPAY Web Site and such communications will be deemed to be received by the customer. Customer will keep themself updated with such communications hosted in www.xpayindia.com site and call toll free no 1800 2002 123 for any clarification/information.
  1. Severability Assignment
The failure of XPAY to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of these Terms shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms of XPAY shall otherwise remain in full force and effect and remain enforceable between the parties. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section.
  1. Indemnification
Customer agree to indemnify, defend and hold harmless Issuer and its affiliates, and its and their directors, managers, officers, owners, agents (collectively “Indemnified Parties”) from and against any and all claims, demands, causes of action, debt or liability, including reasonable attorneys fees, including without limitation attorneys fees and costs incurred by the Indemnified Parties arising out of, related to, or which may arise from: (i) their use of the XPAY Service; (ii) any breach or non-compliance by them of any terms or any of XPAY’s policies; (iii) any dispute or litigation caused by their actions, commission or omissions; or (iv) your negligence/violation of any law or rights of a third party.It shall be the sole responsibility of the customer to safe keep the security keys (User ID & MPIN) provided by the Company. Customer shall be solely responsible and liable for any loss caused to him due to  theft of mobile/any device (wherein the application is saved and operated) or use of your account by any unauthorised person (on ground of negligence or otherwise) and shall keep the Company indemnified against any claims/proceedings. Upon any theft/loss of the mobile or suspected unauthorised use, Customer should immediately take steps to block the XPAY account by calling the customer care number of the Company or by visiting any branch.
  1. Disclaimer of Warranties
THE XPAY SERVICE, INCLUDING ALL CONTENT, SOFTWARE, FUNCTIONS, MATERIALS, AND INFORMATION MADE AVAILABLE ON, PROVIDED IN CONNECTION WITH OR ACCESSIBLE THROUGH THE XPAY SERVICE, IS PROVIDED “AS IS” BASIS. EACH XPAY PARTY DISCLAIMS WITHOUT LIMITATION, ANY WARRANTY OF ANY KIND WITH RESPECT TO THE SERVICE, NON INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. THE XPAY PARTIES DO NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE. THE ISSUER SHALL NOT BE RESPONSIBLE FOR ANY SERVICE INTERRUPTIONS, INCLUDING, BUT NOT LIMITED TO, SYSTEM FAILURES OR OTHER INTERRUPTIONS THAT MAY AFFECT THE RECEIPT, PROCESSING, ACCEPTANCE, COMPLETION OR SETTLEMENT OF PAYMENT TRANSACTIONS OR THE SERVICE.

TO THE FULLEST EXTENT PERMISSIBLE BY LAW, IN NO EVENT SHALL ISSUER BE RESPONSIBLE OR LIABLE TO BUYER OR ANY THIRD PARTY UNDER ANY CIRCUMSTANCES FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY, DAMAGES OR LOSSES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES WHICH MAY BE INCURRED IN CONNECTION WITH ANY XPAY SERVICE, OR ANY GOODS, SERVICES, OR INFORMATION PURCHASED, RECEIVED, SOLD, OR PAID FOR BY WAY OF THE SERVICE, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION, EVEN IF THE ISSUER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE OR LOSS. IN NO EVENT SHALL THE ISSUERS TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATING TO XPAY EXCEED THE NET FEES XPAY HAS ACTUALLY RECEIVED AND RETAINED FROM THE BUYER’S VALID PAYMENT TRANSACTIONS DURING THE THREE MONTH PERIOD IMMEDIATELY PRECEDING THE DATE OF THE CLAIM. Each party acknowledges that the other party has entered into these Terms of Service relying on the limitations of liability stated herein and that those limitations are an essential basis of the bargain between the parties. In addition to and without limiting any of the foregoing, Issuer shall not have any liability for any failure or delay resulting from any condition beyond the reasonable control of the Issuer, including but not limited to governmental action or acts of terrorism, earthquake, fire, flood, labor conditions, power failures and Internet disturbances.Company is not liable for the internet access device or password obtaining device used by the Customer (such as Computer or mobile phones, etc.) or proper functioning of its hardwarreor software before, during or after the use of XPAY application/site. Company will not take the liability for any virus or unlawful downloads that Customer system may be exposed to while accessing the internet for using the application/site.
  1. Insolvency Policy
In any event Company initiates insolvency petition, Company shall give due intimation to PPI holders to do balance transfers to beneficieries. In which absence/otherwise, all escrow balances/methodology/quantum of compensations (if any) will be apportioned to creditors as per the order of the court.
  1. Assignment
The Company may assign its rights and obligations herein to its affiliates/third party entity in connection with a merger, takeover or the transfer of all or substantially all of the business and assets. Except as provided above in this clause, the Comapany may assign its rights and obligations under this Agreement to a third party and an intimation to this effect shall be made to the customer/merchant within one month of such assignment.
  1. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of India.
  1. Disputes
XPAY may provide various tools to assist Customers in communicating with each other to resolve a dispute that may arise between Buyers and Merchants with respect to XPAY transaction. Customer agree that you will not involve XPAY in any litigation or other dispute arising out of or related to any transaction or arrangement purely between the customer and the Merchant, advertiser or other third party. If you attempt to do so, (i) you shall pay all costs and attorneys fees of Issuer and shall provide indemnification as set forth below, and (ii) the jurisdiction for any such litigation or dispute shall be limited as set forth below. Any dispute/ controversy arising out or in connection with XPAY shall be referred to an arbitrator appointed by the Issuer as per the Arbitration & Conciliation act, 1996 & its amendments (if any) & will be subject to the jurisdiction of courts at Kochi, Kerala, India.Headings to the Clauses of this Agreement are inserted for convenience only and shall not affect the construction or interpretation of this Agreement.

The customer can visit our website without revealing the customer’s identity or any personal information, but the customer may be unable to access certain options, offers and services. We track the Internet address of the domains from which people visit us and analyze this data for trends and statistics, but the individual user remains anonymous. For better management of the site, we may (i) log the customer’s browsing history, (ii) log non-personally-identifiable information, including IP address, profile information, aggregate user data, and browser type, and (iii) record User IP addresses for security and monitoring purposes. CookiesWe may place a text file called a “cookie” in the browser files of the customer’s computer. But the only personal information a cookie can contain is information the customer supply. A cookie cannot read data off the customer’s hard disk or read cookie files created by other sites. Our advertising system may deliver a cookie to better track ad impressions and click rates. The customer can refuse cookies by turning them off in the customer browser. If the customer has set the customer’s browser to warn the customer before accepting cookies, the customer will receive the warning message with each cookie. Even without a cookie, the customer can still use most of the features in our store, including ticket booking, confirmation, ticket availability/rates etc. Member Communications and EmailWe employ a strict policy against sending unsolicited email. Please note the opting not to receive email does not exempt the customer from receiving administrative emails that include but are not limited to, notices about vital program and membership status changes, Privacy Policy and Terms of Service updates and purchase and redemption confirmation emails, if any. Our Customer Care department may contact the customer in response to the customer’s inquiries, to provide services at the customer’s request and to manage the customer traveling/ticketing requirement. We will communicate by email or telephone in accordance with the customer’s wishes. UAE EXCHANGE Advertisers and 3rd Party WebsitesWeb portals AMADEUS (www.amadeus.com), Galileo (www.galileo.com) and UAE EXCHANGE (http://www.uaeexchangetravel.com/) all share a common enrollment and sign-on. Information in the customer Member Profile is shared among these portals, and each portal maintains its own privacy policy for protection of the customer personal information. Our website and email may contain links to various other sites. While we makes every effort to ensure that our advertisers post clear and complete Privacy Policies and observe appropriate data practices, each of these sites has a privacy policy that may differ from that of ours. The privacy practices of other websites and companies are not covered by this policy. Except as specifically set forth below, it is our policy not to provide the customer’s personally identifiable information to our advertisers unless the customer make the choice to share it with them. We occasionally pass personally identifiable information via a secure interface to certain of our advertisers for the purpose of making it easier for the customer to sign up for their offers, however, this information is only to be used by the advertiser if the customer agree to submit the information to the advertiser for the purposes of completing an offer. We occasionally hire other companies to provide limited services on our behalf, such as handling the processing and delivery of mailings, providing customer support, processing transactions, or performing statistical analysis of our services.
